Understand your speeding ticket

What you were charged with, and what the prosecution must prove.

In Ontario, speeding is charged under section 128 of the Highway Traffic Act. Most tickets are a Part I offence notice with a set fine printed on it. The fine rises with how far over the limit you were caught, and speeds of 50 km/h or more over can be charged as stunt driving / racing (s. 172) — a much more serious matter that this kit does not cover.

To convict you, the prosecution generally has to prove: that you were the driver, the date and location, that there was a posted or statutory speed limit, and your speed as measured. Every one of those is something you can test.

Pull out your ticket now and confirm the offence date, the location, the alleged speed and limit, and the officer’s name and badge number. Errors here matter later.
